Terms of Service

Please read these terms carefully before using FairClose.

Acceptance of Terms

By accessing or using FairClose ("Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this Platform. These terms constitute a legally binding agreement between you and FairClose.

Eligibility

  • You must be at least 18 years old to use this Platform
  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account
  • You may not transfer your account to another party
  • We reserve the right to refuse service to anyone for any reason

Auction Rules

For Bidders

  • All bids are binding and cannot be retracted
  • You must have the intent and ability to pay for items you bid on
  • Winning bidders are obligated to complete the purchase
  • Failure to pay may result in account suspension
  • QBC rules apply to all auctions (see QBC Explained page)

For Sellers

  • Listings must accurately describe the item being sold
  • You must have the legal right to sell the item
  • Prohibited items include counterfeit goods, illegal items, and hazardous materials
  • Sellers must ship items within the specified timeframe
  • Platform fees apply to all successful sales

Fees and Payments

FairClose charges the following fees:

Seller Fee

7% of final sale price

Buyer Fee

6% of final sale price (3% for Buyer Plus members)

  • Fees are non-refundable except in cases of platform error
  • Payment processing fees may apply
  • We reserve the right to modify fees with 30 days notice

Limitation of Liability

FairClose acts as a marketplace platform connecting buyers and sellers. We are not a party to the actual transaction between users and do not take possession of items being sold.

  • We do not guarantee the quality, safety, or legality of listed items
  • We are not responsible for disputes between buyers and sellers
  • Our liability is limited to the fees paid to us for the transaction
  • We are not liable for indirect, incidental, or consequential damages

Prohibited Activities

You agree not to:

  • Use the Platform for any illegal purpose
  • Manipulate bids or engage in shill bidding
  • Create multiple accounts to circumvent restrictions
  • Harass, threaten, or defraud other users
  • Interfere with the proper operation of the Platform
  • Scrape or collect user data without permission
  • Post false, misleading, or defamatory content
  • Attempt to bypass security measures

Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or any other reason at our sole discretion. Upon termination, your right to use the Platform will immediately cease. Any outstanding obligations (such as payments owed) will survive termination.

Changes to Terms

We may modify these Terms of Service at any time. We will notify users of significant changes via email or platform notification. Your continued use of the Platform after changes are posted constitutes acceptance of the modified terms.
